1.1 Eligibility

• Attempting to circumvent any technological measure implemented by Buzz to protect the Services or prevent or restrict access to the Services
• Attempting to decompile, reverse engineer, or otherwise attempt to discover the source code of the Services
• Interfering with or disrupting the integrity or performance of the Services

3.1 Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Services or the servers that make them available are free of viruses or other harmful components.

3.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUZZ AND ITS OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

4.1 Governing Law

These Terms and any action related thereto will be governed by the laws of the State of California without regard to its conflict of law provisions.

4.2 Agreement to Arbitrate

You and Buzz agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof or the use of the Services (collectively, "Disputes") will be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

5.1 Entire Agreement

These Terms constitute the entire agreement between you and Buzz regarding the use of the Services, superseding any prior agreements between you and Buzz relating to your use of the Services.

5.2 Waiver and Severability

The failure of Buzz to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

5.3 Changes to Terms

We may modify these Terms from time to time. If we make material changes to these Terms, we will notify you by email or through the Services. Your continued use of the Services after such notification constitutes your acceptance of the updated Terms.
